This Release and Voluntary Liability Waiver (“Agreement”) is hereby executed by the undersigned player, or if the player is under the age of 18 years, then the player’s parent or legal guardian, together with their estate, and any heir, executor, devisee, representative, successor or assign (collectively “Participant”), in favor of and for the benefit of the Organizers (as defined herein). In connection with Participant’s involvement in any game, contest, promotional event or other activity which may take place in any way related to the 3-on-3 basketball tournament and festival referred to as Hooplandia, Hooptacular, respectively, (the “Event”), or which involves the use by the participant of the streets, parking areas or any other indoor or outdoor facilities at the property of the Eastern States Exposition located in West Springfield, Massachusetts or the Naismith Basketball Hall of Fame located in Springfield, Massachusetts, the Participant hereby agrees and acknowledges to the Eastern States Exposition, the Naismith Basketball Hall of Fame, and all other respective Event sponsors or promoters, including, without limitation, all donors to the Event or charities benefiting from the Event, individually and collectively, together with each of their respective affiliates, officers, employees, partners, shareholders, members, board members, sponsors, volunteers, tenants, contractors, agents, successors and assigns (collectively “Organizers”), that strenuous activity, such as basketball, is potentially hazardous, and Participant hereby assumes any risks associated with participating in the Event, including, without limitation, falls, contact with other participants, the effects of weather, the condition of playing surfaces or any other circumstances that may result in property damage, personal injury or loss of life. Furthermore, Participant expressly and unconditionally assumes all risks and dangers known or unknown, foreseen or unforeseen, and relating in any way or incidental to Participant’s involvement in the Event and any activity associated therewith. Participant hereby releases, forever discharges and holds harmless the Organizers from and against any and all claims, damages, liabilities, costs and expenses, including, without limitation, death, personal injury or property damage of any kind or nature, arising out of or relating in any way to Participant’s involvement in the Event and all activities associated therewith. Participant further agrees that the Organizers shall have the right to record, broadcast and otherwise exploit in any and all media throughout the world Participant’s involvement in the Event and to use Participant’s name, likeness, voice and biographical information in connection therewith.
Consent
Participant understands the above release and voluntary liability waiver and agrees that their signature on this form shall be legally binding and such transaction shall be deemed fully authorized by Participant.
PARENT OR LEGAL GUARDIAN ACKNOWLEDGEMENT (IF UNDER THE AGE OF 18)
I represent and warrant that I am the parent or legal guardian of the individual who completed the foregoing Release (“Minor”) and that I have received, read, and understood the foregoing Release and Waiver. I fully consent to and voluntarily authorize the Minor to execute said Release and Waiver (or, if applicable, have voluntarily executed said Release and Waiver on Minor’s behalf). I acknowledge and agree that all representations, consents, agreements, grants, waivers, authorizations, indemnifications and releases herein shall be regarded as made by me on behalf of the Minor and shall be binding on me and the Minor.
