Genesis Hoops Inc. DBA Starters Basketball League and 3on3 Runs ACTIVITY WAIVER AND RELEASE
(This document only needs to be signed once, and will cover any/all future interaction and participation in Genesis Hoops Inc. DBA 3on3 Runs activities)
In consideration of being allowed to participate in the ATHLETIC TRAINING, CAMP, CLINIC, LEAGUE, or related events or activities, which hereinafter are referred to individually and/or collectively as the “Program”, offered by Genesis Hoops Inc. DBA 3on3 Runs:
I hereby assume all of the risks of participating in this Program, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained or controlled by them, or because of their possible liability without fault.
I certify that I am physically fit and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in this Program. I acknowledge that this Accident Waiver and Release of Liability Form will be used by the organizers of the Program in which I may participate and that it will govern my actions and responsibilities in said Program.
In consideration of my application and permitting me to participate in this Program, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:
(A) I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from facilities used for this Program. THE FOLLOWING ENTITIES OR PERSONS: Genesis Hoops Inc. DBA Starters Basketball League and 3on3 Runs, Genesis Hoops Inc., Rudy Brown, and/or their coaches, agents, representatives or volunteers, and/or facilities used for the Program.
(B) I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this paragraph from any and all liabilities or claims made as a result of participation in this Program, whether caused by negligence or otherwise.
I acknowledge that this Program may carry with it the potential for death, serious injury, and personal loss. The risks may include, but are not limited to, those caused by terrain, facilities, temperature, weather, condition of participants, equipment, vehicular traffic, actions of other people including, but not limited to, participants, volunteers, spectators, coaches, and lack of hydration.
I consent and agree that Genesis Hoops Inc. DBA Starters Basketball League and 3on3 Runs, and/or their coaches, agents, representatives or volunteers may take photographs or digital recordings of me and/or participants during this event and use these in any and all media for training or promotional purposes. I further consent that my identity may be revealed therein or by description text or commentary. I waive any rights, claims or interest and I understand that there will be no financial or other remuneration.
This accident waiver, release of liability and image release shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. I acknowledge and accept the Genesis Hoops Inc. DBA Starters Basketball League and 3on3 Runs no refund policy. I agree that if any portion of the agreement is invalid, that the remainder will continue in full legal force and effect.
COVID-19 Return to Training Release and Waiver (Updated 2021)
According to the USOPC Chief Medical Officer, although the young and healthy tend to have less severe cases of COVID-19, every case of this disease is potentially life altering or deadly. Until COVID-19 is eradicated, even if an effective vaccine is developed, or a cure is found, there is no way of completely eliminating the risk of a serious or fatal infection. This should always be in the forefront of your mind when deciding whether to return to training. Each of our members and their families are responsible for making their own judgment as to the degree of risk of contracting the COVID-19 virus that they are willing to take in order to return to in person basketball activities based upon their individual circumstances, including the prevalence of the virus in their locality, whether a particular member is particularly vulnerable to the virus, and the precautions being taken by others they may come into contact with.
As a program, we ask that everyone do their best to take care of themselves and their fellow teammates both during and outside of training sessions, understanding the social responsibility that comes with participating in a group activity. This allows in person trainings and activities to continue for all.
Knowing the risks described above, I agree, personally and on behalf of my player/participant/family to assume all the risks and responsibilities surrounding participation in in-person training sessions and practices. To the fullest extent allowed by law, I hold harmless and agree to indemnify Genesis Hoops Inc., its owners, directors, coaches, and employees, from and against any present or future claim, cause of action, loss or liability for injury to person or property, which said participant may suffer or for which said participant may be liable to any other person, related to said participant's involvement in basketball training and/or practices resulting from any cause whatsoever and regardless of fault.
* The above signature is on behalf of the parent(s)/guardian(s) and player(s) participating, as many as are participants in any and all Genesis Hoops Inc. program.
I CERTIFY THAT I HAVE READ THIS DOCUMENT, AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT ON MY OWN FREE WILL. Electronic acceptance of this document is considered the same as signed acceptance.

FOR PARENT/GUARDIAN OF MINORS (Participants under 18 years old):
Parent and/or natural guardian does hereby represent that he/she is, in fact, acting in such capacity, has consented to his/her child or ward’s participation in the Program, and has agreed individually and on behalf of the child or ward, to the terms of the accident waiver and release of liability set forth above. The undersigned parent or guardian further agrees to save and hold harmless and indemnify each and all parties referred to above from all liability, loss, cost, claim, or damage whatsoever which may be imposed upon said parties because of any defect on lack of such capacity to so act and release said parties on behalf of the minor and the parents or legal guardian.
As parent of natural guardian, I also certify that the participant has permission to be transported by members of the program. Permission is granted for participant to receive emergency medical treatment, if needed. I also agree to indemnify and hold harmless those listed above for all claims arising out of Participants participation in the Program and all related activities.
I am of legal age and am freely signing this agreement. I have read this form and understand that by signing this form, I am giving up legal rights and remedies.
